New member here! Just bought 5,000 points/yr at Paradise in LV on ebay for $1. I was just wondering, what are the chances this gets through ROFR? The deed is for a 2bd 2ba in Gold season. Also, we just rescinded our purchase that was made in Parc Soleil in Orlando. We sent our rescission next day on the 8th day, but have not received a notice. This was delivered on June 22. How long do they give you notice that the cancellation has gone through?

My best guess is that they'll exercise ROFR on that one. Whatever happens, please post results in the ROFL "sticky" note at the top of this forum to help make it more useful.

Congrats on your rescission. You won't get a notice (it's not required by law), just a credit or refund for whatever $$ you paid. The sales-weasel you dealt with might call you trying to save his commission, but nothing good would come from talking to him and we advise against it.

Tend to agree with Talent, I don't see that passing ROFR. I see these $1 sales occasionally on ebay etc... and always wonder if/how they pass ROFR. Just curious what is the MF on that property?

The MF on the property is quoted as $1070. Also, I messaged the seller if they thought it would pass ROFR, and they responded saying they can rework the contract to make it seem as the total fees (closing + Hilton equaling $1600) was the purchasing price. Should I trust the seller on this? Just hoping they don't come after closing costs etc. on top of this.

Do you know the seller? Probably not. I would not trust them...

We just rescinded from an HGVC sales presentation in May. We saw the credit come back through on our credit card first, and then actually received a letter from HGVC confirming the recission.

Not sure about correct legal answer, whatever the contract says...

I would guess yes specially if you paid the down payment with a cc.

Charges can be disputed up to 60 days after the date of the statement in which the charge appears.
However, by all accounts, HGVC is a stand-up company which will do the right-thing.
Even to the point of allowing a slightly ate rescission when the buyer whined loud enuff.

I want to chime in: if HGVC does indeed take the re-sale purchase with ROFR, don't despair, do keep trying! I had three contract get taken... before I landed two last month. good luck!

Thanks jeepinjoel! I know the only thing lost would be time, but we just want to start vacationing already! The waiting is the worst part..

What is ROFL?
ROFL is "roll on floor laughing"
ROFR is "right of first refusal", meaning the developer has first dibs on any resale.

Not really surprised either. As I questioned up thread these one dollar sales seem strange to me. It almost seems like they are either trying to give it away or get the developer to exercise a ROFR just to get out of there MFs. Having said that, I see them listed all the time online.
