Denied exchange ? (Trading Places)

In December '09 Fairfield/Wyndham denied my request to exchange my week at Wyndham Grand Desert, Las Vegas for a resort in Mexico using Trading Places International. I pay my own membership fee to Trading Places International. Trading Places accepts Wyndham Grand Desert property in their exchange program. I own 315,000 points at Wyndham (Undivided Ownership Interest) that I purchased from Fairfield Communities, Inc., in December 2001. I am a FairShare Plus member.

I made four similar exchanges Fairfield/Trading Places November '06 through November '08.

I think Wyndhams current position is exchanges made by or through the FairShare Plus Program, can only be made through RCI; citing Item 23, in my Fairshare Plus Vacation Ownership Interest Purchaser's Affidavit, dated 12/06.

I believe them to be wrong! Any suggestions on how to proceed with this Wyndham position? Wyndham has devalued my timeshare investment by not allowing me to trade through Trading Places which has a lower exchange fee and 2 for 1 week bonus program when compared to RCI.

Is an exchange by definition any different than renting?

In the same Fairshare Plus Ownership document are sections as follows: #11 "Seller has no obligation to assist in the rental or resale of our Property interest"; and #17 "We acknowledge that SELLER will NOT rent our Property for us. Should we decide to rent our Property it will be solely our responsibility."

Have any other Wyndham owners had a similar problem making exchanges with SFX or DAE?

The only resort they said was able to trade with Trading Places were the Hawaii resorts. I recently acquired Hawaii and was told that I could use Trading Places as well as RCI.

Question Coarsegold Bob

Why go through Wyndham at all. Why not just reserve the week you want, with your home resort, and then take that confirmed week and deposit it directly with Trading Places? Seems to me, that would be the easiest thing to do. Am I missing something?

I booked a week with Wyndham and then deposited it to SFX in the last 2 months, without problem. I had to add the guest's name once SFX exchanged it, which I did without problem. It did count against my 5 free guest certificates for the year (VIP).

Tony I tried what you suggested and was denied by Wyndham! I confirmed a week at Wyndham at Grand Desert. When I fax'ed the signed request for an exchange on the Trading Places document Wyndham refused to release my week to them and blocked the exchange without explanation. I had the number of points, all fees paid and Wyndham simply said I could not make the exchange! After several months and two submissions for the exchange request through Trading Places Wyndham referred me to item 23 of my Fairshare Plus Vacation Ownership Interest Purchaser's Affidavit, I signed 12/'01. I pulled it out of my files and read the section and found nothing giving RCI/Fairshare Plus the exclusive right of exchange of my weeksl As stated in my earlier statement I have exchanged weeks four times prior through Trading Places using my Grand Desert timeshare.

IPRSTN I understand a benifit Wyndham Hawaii owners have are trades through RCI and Trading Places as part of THEIR purchase agreements. I am not requesting the exchange merely because I am a Wyndham owner. I have paid for my own individual membership to Trading Places. As best I can learn Wyndham has arbitrarily decided I cannot use my week for an exchange using Trading Places, because THEY don't recognize my individual membership with Trading Places. It simply defies the premise they are my weeks and I can use them the way I want.

Cirkus thanks for the reply. The criteria for an exchange using my Wyndham Grand Desert timeshare per my "Purchaser's Affidavit", signed by me on 12/'01, is the willingness of SFX, DAE and Trading Places to accept the property for an exchange not the other way around. Wyndham seems to have block the request due to some internal company conflict with the Hawaii properties. The sales pitch for Hawaii properties would have less impact if new buyers were aware the same exchange privileges with Trading Places is FREE. The Trading Places membership fees are only necessary for additional benefits. Your information has helped!

Antitrust Violation?

Since Wyndham (through RCI) dominates the timeshare exchange industry, it would seem as though Wyndham is opening itself up to antitrust violations by refusing to allow other exchange companies access.
Do we have any attorneys here who would like to give an opinion?

Resorts: Wyndham VIP Platinum, HGVC Elite, Tradewinds Cruise Club, + 4 others
I do trade via SFX and to date Wyndham has not blocked that.

I guess I will find out if things change this year, as this is usually about the time I deposit.

You may want to talk to TPI people first. Wyndham has some deal with their Hawaii resort to them. So there may have some contract agreement that what they can and can not take.

I believe DAE and SFX has a long fight with Wyndham way before, and now Wyndham will confirm the exchange. Still each new resort will be a new fight for them to get confirmation.

Jya-Ning I have talked with Trading Places. They accept Wyndham Grand Desert and it was Wyndham that denied (my) their exchange request! Trading Places always has been great with me. The PROBLEM is with Wyndham not exchanging the week I had confirmed at Grand Desert for the exchange at the Mexico resort on 24 hr hold by Trading Places.

That my impression from reading post from various exchangers. And I believe they (TPI) have accept exchanger from other Wyndham resorts. Since one time when I checked their inventory, I saw Bay. But that is a while ago, so don't know if they have signed any special contract with Wyndham or not.

You will need to ask TPI to help. You can fax your confirmation with Grand Dessert. Ask them if you should have 3 way call between you, them and Wyndham. As a small exchange company, it is also their best interest to make sure that those mini point resort chain does not exclude them out from potential exchanger. And I do know a long while ago, some of the small exchange company has to fight with those mini-chain to get through the confirmation.

TPI and Wyndham

I own in HI and TPI is a "benefit" - I have also heard that Wyndham has tried to pull this benefit at several points. Clearly with owning RCI they do not want to support other trading companies - I don't know of SFX but I suspect that because it has NO agreement with Wyndham - it is not seen as a threat. Also owning in HI allows you to deposit an HI week with TPI and get two weeks with TPI - this is the reason they allow it stay is that Wyndham HI owners have a real advantage in TPI (though I've had a hard time getting my account set up).
