cancelling a time share purchased in florida.

Hello everyone. I have a question regarding cancelling a time share agreement. First off we were at a resort, went for the presentation and got sucked in with the promise. After looking at everything we are having second thoughts. I see there is 10 days to cancel in florida. My question is is that ten days after we sign or after our down payment has been fulfilled? We did not fully pay the down payment yet and I was hoping maybe it was ten days from the down payment since they told us we have no benefits until down payment is completely paid. this was purchased while in Florida at holiday inn vacation club. The property is at their Galveston Texas property. Thanks for any advice!!

Unfortunately, it's 10 days from the date you signed.

How much have you given them so far?

What payment method were you supposed to use to make the rest of the down payment?

They took the down payment off cc. so i made 1/3 of down payment. Then they said they would just charge monthly the card until full down payment.

Since you have already given them permission to charge your credit card, it appears that you are committed, and it's a done deal.

while you appear to be just out of your rescission period, worst thing they can say is no.

If you are outside the cancellation period you may still a little wiggle room but probably not.

If you cancel that CC they won't be able to charge it.

Take Brian's advice and try to cancel as if you were still in the rescission period.

Let them know you have changed your mind and will not be making any further payments. There may be some credit consequences but how many thousands will you be paying out if you don't stop now? That's the choice you have to make.

Thanks guys I will give canceling a shot. Guess the worse they can say is no. If I am stuck I will be on here researching how to make the best of it!!

You'll hear others say that you're screwing all the other owners if you don't keep paying but I don't agree in this case. Wyndham is picking up the MFs for the unit you bought right now so it is Wyndham you'll be screwing. You remember them, they're the ones who sold you this unit at a grossly inflated price.

It is strange that everyone rushes to blame Wyndham, even in cases such as this where they have nothing to do with the situation.

It is strange that everyone rushes to blame Wyndham, even in cases such as this where they have nothing to do with the situation.

I was about to ask why Wyndham was paying the maintenance fees for a Holiday Inn Vacation Club unit.... :)

Just having a little fun John - I'm a Wyn owner, and I like to blame them for everything too.
