Seeking a reputable attorney for intra-family transfer

Greetings TUGgers,

I am seeking to remove a party from the ownership of my timeshare. They are in full cooperation and are not seeking any money. Thus, I (think I) just need a deed between us removing them from the title. I read over the post on the main site, and it looks like an attorney is needed in Hawaii, according to this other list on the main site.

I contacted Mark Bidwell, after Googling a bit, and he'd charge $250 for said services. Are there better deals? Is this person reputable? As you can relate, I'm very wary of scams after being a timeshare owner for several years.

If their is an exchange of funds involved, you need the escrow to be held by a company that is approved to do business in Hawaii, but that doesn't appear to be the case here.

For simple deed transfers, I use this company. They are Tuggers, and are highly recommended by Tuggers:

We are wanting to transfer our deeded time share to our son. I have reviewed the transfer companies listed here, but it appears they just cover the United States. Our timeshare is located in Cabo. Does anyone know of a company in Mexico or in the U.S. that will work with a Mexico based timeshare. Thank you for any direction on this process. I have considered hiring an international attorney for this and have located a few to research, but I am thinking the expense might be excessive for just a family transfer.

Deeded TSs are rare in Mexico. Have you checked with the resort for what is required? They title their intervals to US citizens all the time, so thats where I'd check first.

Passepartout, you are correct...it is actually contracted as fractional ownership. I have checked the contract and it states I will need to contact them for a form and pay a $300 fee to the resort. I am stuck on the followup. I had read on the Quit Claim deed & that looks pretty simple. Now just the follow up.....I would need to find where to file the deed in Mexico? Would that require an attorney or would I just find where in Cabo I would need to file the deed myself & pay those fees. Is that all there would be to it?

Just get the form from the resort, pay their fee and let them handle it. I still suspect that it's a Right To Use, and there's an ending date, but no matter. They do these all the time.

As far as I know Mexico TS "ownership" by US Citizens is RTU, so no deed.

Contact resort and pay $300 and they should take care of. Their fee is very reasonable compared to most Mexico TSs.


Wyndham is $299 and people generally pay closing company $150+!
