Hi there:

I am new to Tugs. I own 3 timeshares, two of which I never use. While searching around to find out how I can sell or transfer them, I ran into the above mentioned companies - one Canadian & one US. They are a document assistance & resolution company to help terminate the agreement.

Of course there is an upfront charge of $2595.00 per timeshare. They offer a 24 month 100% refund if they are not successful of course they are other disclaimers.

My question
1) Has anyone ever successfully dealt with them?
2) Has anyone successfully sold/transferred Summerbay Resort or Bonaventure - Vacation Village resort.

Your assistance is appreciated.

The general recommendation here on TUG is to stay away from these type of companies. If you want to divest yourself of ownership, we have three different recommendations.

1) Try the free giveaway method here on TUG:

http://tugbbs.com/forums/showthread.php?t=132509

2) Try selling it:

http://http://tugbbs.com/forums/showthread.php?t=132509

3) Try asking the resort if it will take the interval back:

http://tug2.net/timeshare_advice/give_back_timeshare.html

With a little work and patience, these methods will prove to be far cheaper, and likely more effective, than paying a transfer company to "get you out of your timeshare".

Welcome to TUG. Our experience has been that any outfit that charges an upfront fee is at best, suspect. Most are flat-out scams who simply take your money then disappear, or pop up under another name. You still own your timeshare, and they have your money. Another scenario is that they have you sign a 'quit-claim' deed to transfer your ownership to a fly-by-night limited liability entity we've come to call a 'Viking Ship'. When they get enough timeshares in it, they bankrupt (sink) the Viking ship, leaving the rest of the home owners at the resort to foreclose, and re-sell the abandoned property, meanwhile the maintenance fees go up on everyone.

Why not simply list your timeshares in the TUG Bargain Deals at the top of this forum for free. You might have to offer to pay the transfers, but there are TUGgers who do it for $150ish. Just follow the basic format you'll see there, Resort name, size, season, that it's paid-off, how much the MF is, etc. Many people have had great success doing this.

Best wishes.

Jim

No magic beans, no pixie dust...

They are a document assistance & resolution company to help terminate the agreement.

They are not magicians. Accordingly, they cannot somehow unilaterally terminate a contractual obligation (...yes, that's what you have and it is considerably more than just an "agreement", from a legal perspective).

The only thing that these "magicians" can or will actually make disappear is $2,595.00 of your money, apparently per individual timeshare week.

You can find a valid new home and recipient for your timeshares for a whole lot less, including by just giving them away here on TUG for free, if they have little or no actual market value (I don't claim to know their resale value, if any). See the "Bargain Deals" forum. You would be wise to not spend that $2,595.00 x 2, in any case.

Thanks for the confirmation of my gut feelings!

Here is something interesting though. Two weeks ago I received an email from our Timeshare in St. Martin that was an Annulment of the Timeshare Agreement. The properties were auctioned off by the Bank & we are no longer entitled to make use of our timeshare unit or related timeshare exchanges! I am not sure how they can do this but they did!

I will take your advice & utilize this website to find a new home for my remaining two timeshares.

Foreclosure and subsequent property auction notification BY EMAIL? Seriously?

Two weeks ago I received an email from our Timeshare in St. Martin that was an Annulment of the Timeshare Agreement. The properties were auctioned off by the Bank & we are no longer entitled to make use of our timeshare unit or related timeshare exchanges!

Although I cannot speak to the laws and / or legal practices of other countries (i.e., anywhere outside the U.S.), I find it extremely odd (...and frankly, outright suspicious) that notification of a legal action of this magnitude and consequence would be provided by email message.

How would others with contracts there who don't even use the Internet (surely, there are some) and / or people who've simply changed an email address ever receive formal notification of this significant legal action? Obviously, all have snail mail addresses on file in resort records (for contracts and billing).

Out of curiousity, did you make any effort to independently verify the legitimacy and / or accuracy of this very strange "legal notice via email message"? :ponder:
