AGAIN: The sales person has nothing to do with rescinding - he is just terrorizing you because you rescinded and he lost his commission.

You are falling right into the trap, by being so gullible.

Cut off all contact with him and he will go away.

You are done - walk away, and don't go to any more timeshare presentations.

So it seems we might have gotten our deposit back on the credit card and that we canceled as well. Does anyone know how to find out if our contract is canceled without dealing with the sales people, he is bullying us into thinking since we made our first payment it would be impossible to get out of our contract. But i think we got our money back. Just waiting for the check from the cc company

Congratulations, you successfully rescinded. The salesman is pissed that he lost a commission. He's trying to bully you by (more) lying. Declare victory and stay away from these people in the future.

We just called the company that we have a mortgage on due of 20k and they are saying that we still have an open balance. We have our pending deposit coming back but how does this go away?

When you rescind the ENTIRE purchase is cancelled as if it never happened - the lender will be informed of the cancellation by the department that handles rescissions.

Your reluctance to accept victory and move on is noteworthy.
More so than anything they are doing which is as expected.

These things do take some time to unwind, but unwind it will.
Don't take or make any phone calls about this. Try to be patient.

So the plot thickens. I called the credit card company and they told me that occidental is who credited our money back. The sales guy is calling us now saying he's got my ss number and he is threatening collections on us. I am not sure if he knows that we got the money back. I guess I am a little skeptical because it seems that everyone has such horror stories. Is it too good to be true that we were refunded so quickly? And if we are refunded why is he calling us saying we owe on the rest of the package. He said the company knows you are not going to be making payments and they will go after you. Does anybody have anymore advice. What is our next step.
Do we call the resort to confirm cancellation? How does profeco get involved?
Record phone calls with him from now on (tell him that you will be recording call and if he does not wish to be recorded he can hang up now). Use recording for complaints to bbb, attorney general, ftc, fcc, etc..
