Who knows what the seller thinks. He called me today after I filed a complaint with ebay. He was not very nice and sounded condescending. Needless to say, I will never buy from that company again. They recorded the wrong deed to begin with. I brought that to their attention and it was fixed. However, this beats all I have ever seen. It's not like I'm asking for them to do something that wasn't listed in the ad. I just want them to honor the ad.
The deed has already been recorded and the transfer is complete. I didn't know about the seller not paying the 2012 fees until yesterday when I called the resort to check on points, etc. As far as a contract, I did sign something after I won the auction. I don't really remember. I have had my hands full here. We have had a lot of bad weather, tornados. I have had trees on my house. My computer was fried in the storms. It has been really crazy around here. I'm just not very happy with this company.

Sorry to hear of your troubles. I'm sure that this issue only adds to your annoyance.
IMHO, its important to know what your contract (the document you signed) says on this issue. It will trump whatever the ad said. If its consistent with the ad, you can throw that at them, but if it contradicts the ad, your goose is cooked. The ad is mere puffery; the contract controls.
Also: If the deed says that the seller warranties title, except for taxes and other liens imposed for the year 2012 and thereafter, that may also constitute a waiver of any prior agreement to the contrary.
I'm not trying to defend what these people did, but merely suggesting that, ads should be taken for what they are: Puffery. What's important is what's in the contract and deed.
I just remembered that the contract was done thru docusign. So I went and pulled it up online. The contract had the incorrect deed listed. It was for the first deed they recorded which was the wrong one. They never did a second contract. Also the contract only says:
Assignor/Seller discloses current yearly maintenance dues/fees & taxes to be approximately: $1,273.52 (including club dues). Seller
paid 2011 fees - Next due 1/1/12.
So it never said that the buyer was responsible. Also, it is for the wrong deed. That is how incompetent they are with their deeds.
I paid at the end of the auction. It was only $50.
Since it's clear the 2012 fees have not been paid and you signed a contract to that effect, you have no legitimate claim unless the contract also has a statement that the seller promises to pay the 2012 fees.
