Help w/ Contract Language

Last month, we bought our 1 week/yr for 30 years TS in Mexico (starting 2009) and just received the Certificate. While reviewing the Certificate, I have a few questions that I don't understand. I sent email to the resort and salesperson for clarification but they have not responded to my questions. Anyone knows what it means, please help me. Some people told me this is a "every other year" TS, which was not we were presented (I still have the presentation Worksheet from the salesperson). If this is indeed a "every other year" week, what can we do because this is not what we thought we bought.
The Certificate states:
- Use Season or Week BI ANNUAL ODD for each (15) odd years...
- The User will take only the interest in the TS interval as set forth hereinand will RELINQUISH any and all residual rights of the claims to such interest on the expiration of the (15) consecutive use periods of user(s).
- .,.. From Week 1 to Week 50 only in 2007

The Certificate states:

You only get to use it every other year - 2007, 2009, 2011, etc.

After 15 use years, your rights to the property ends completely.

You cannot reserve weeks 51, 52, or 53 (Christmas and New Years)

Unfortunately, TS salesmen in Mexico are notoriously crooked...

If I were you, I would post on the TUG Mexico board and ask for info. about getting out of the contract. Then, if/when you get out of it, DO NOT buy another TS in Mexico from the developer - you can buy them for pennies on the dollar on ebay and many other places.

Surely you must have a contract (not a worksheet) which spells out exactly what you own??? What did you sign and what does it say? It definitely sounds like you bought an every other odd year for a total of only 15 years.

You got a bianual right to use for 15 years. This is not uncommon for Mexico. Too bad you did not stumble on to us before you purchased. However, Mexico resorts can be enjoyable.

I did review my contrat that I signed, it clearly stated that
UNITY TYPE JUNIOR ONE WEEK INTERVAL PER YEAR IN RED O - SEASON FIRST USE YEAR 2009 (my request, since we already have vac plan for 2008)
However, I could not find anywhere stating 30 years. I just sent copies of all my contract document to the Sales Manager via Certified w/ Returned Receipt and hope that he can help. Let's wait and see. I will keep you all posted.
This resort is Pueblo Bonito Emerald Bay. The reason we bought at this place was because it was a nice resort; we heard good things about it too. However, I am very disappointed about how my sales person (Sara Drobac, if you want to know). She appeared very professional, honest and knowledgable. We highly trusted her, but she turned out to be very very disappointed, never response to my email questions, even my long distance call to Mexico.
Anyway, I have done everything I can. Anyone has any suggestions next, please let me know. Thanks again all.

The good news is that I think the resort will alllow you to buy the other half the Every E season, but I doubt they will allow you to put off use until 2010. Best of luck, Greg

The contract will expire in 30 years but you will have 15 weeks to use, every odd year. The salesman probabbly said the contract was for 30 years but apparrently didn't emphasize the every odd year usage.

Snazzy, confusing language. Red O is, as the others have told you, odd year I would guess.

Update on my case in regard to an error on my Certificate of Ownership.

So after a month screaming and asking help from my credit card and Profecco, I just received the revised Certificate according to my contract with no explanation or apology from the resort. However, I still have not heard from my credit card or Profecco in regard to my request to have the contract to be cancelled. Eventhough the resort sent me a revised Certificate, I still want to cancel it because of their lousy customer service. The imagination that I have to deal this kind of service for the next 30 years make me feel sick. In addition to the fact that they asked us to sign away our rescission period (which they knew it is against the law in Mexico) make me doubt of their business practice. While waiting to hear from my credit card and Profecco, anyone has any suggestions or ideas, please let me know. Thanks all.

Since the rescission period is past, and the resort has corrected their mistake, I am not sure you have any grounds to have the contract canceled - If lousy customer service could get a contract canceled, half of them would be shot down!
