I paid the 3% fee to use my credit card and I'm glad that I did

On September 30, I won an auction for a good amount of money. I chose to pay the additional 3% to utilize my credit card since I have never purchased from this seller. I didn't start asking questions until December. I checked the City's website for deed recording prior to calling. I was told things were wrapping up and it would be on its way to recording shortly. Kept checking City's website. City is usually very quick with recordings. Five weeks after my first inquiry, the deed was still not recorded. I made contact again and was told the deed had been rejected due to an error. I asked for documentation for the rejection. No communication back. I emailed again and told them that I would like proof of rejection and that I had paid additional funds to use my credit card and would dispute if I did not hear back from them. They couldn't provide proof because it had not been sent to recording. They were still awaiting the owners to sign off on the deed over three months later. Excuses were given and I was told that they had up to 180 days to complete the transaction. I told them my ability to dispute with my credit card company was drawing near and the fact that I had been given false info twice about the status forced my need to dispute. After disputing, the deed was recorded and the transfer completed with the resort took place within less than 10 days. I got the deed in the mail this past weekend. Wrong unit number on the deed. Fortunately, the correct unit was transferred by the resort. I have requested a corrected deed. I received an apology and was told that it would be taken care of. That's where we are, but I am certainly glad that I had the option to use a credit card for back-up leverage. Being provided false information in order to delay things doesn't set well with me. :(

So typical PCC Purchase

I bought a floating week expecting it to take at least 60 days, knowing that other ebay sellers were able to in about 35-40 at the same resort. They insisted upon photo ID and SS# that I know the resort does not require. I even forwarded the email from the HOA saying they don't need these things. They wouldn't back down and said that the ebay auction indicated that they would need these and they would not forward my info to their closing company without these. I backed down and within 3 days of the auction closing, they had this. I waited 4 weeks to get an update. I was told they would get back to me. It took just under a week and they said that they were almost finish preparing the deed and would be sending it to the current owners at the end of the week. That was not what I was expecting. It was finally closed and transferred into my name 90 days from when I forwarded all the info.

This was for a simple transfer with the exception that the county recording office usually takes about 7-14 days. I wouldn't buy a floating week from them at any price unless I knew that I could afford the closing to take 6 months. I wouldn't buy a fixed week from them unless it was at least 6 months from check in date.

I think you can not count on the simplest of closings to take less than 90 days and if there are any complications it could be 6 months.

So typical PCC Purchase

I agree in principle but consider it worse than that. The better, or more efficient "PCC" types have the owner either sign off on the deed prior to sale or they require a POA. They wouldn't be waiting that long for the owner to sign.

If a timeshare has decent value and a licensed broker is involved then I can understand the owner signing later and possibly changing their mind. For everything else it should be buttoned up before hand.

I have the newly recorded deed that has been corrected.

I do love e-recording. My transaction is completed to my satisfaction through the resort where I was already an owner. Everything checks out.

Still, I believe paying by credit card was to my great benefit in getting this all finalized before the 120 day mark.

Do I have a right to complain since this was completed within their time limits of 180 days? Maybe, maybe not. Things broke down for me when I was given false information on the status twice. As stated, "typical PCC purchase."

If the option for a credit card payment had not been offered, then I would not have bid on this auction with this seller. This wasn't a cheapie timeshare. I have had to use credit card disputes previously in order to get things completed with a couple of the PCCs. It's good back-up. The credit card company has either gotten things to "roll" or "conclude" with the return of my funds.

I wish the OP luck in getting the closings completed in a timely and satisfactory manner.

They also have about twice the number of errors on their ebay ads over the average ebay timeshare seller. I would definitely call them worse than average.

Bought end of January on ebay
Just recieved copy of recorded deed
Previous/related entities did not have a good reputation but this transaction was uneventful

I purchased from them on Feb 7. No recorded deed yet. I have been following up to check in on the status. On a positive note, they at least answer the phone but all I keep getting is it is in process.

After much prodding, I finally received a tentative timeline of the deed to be prepared next week. Next will be me asking when it will be signed.....
Fingers crossed :ponder:

I bought a TS from them about 3 weeks ago and am talking to them about another one. As best I can tell, nothing has been done on the first one. I own quite a few weeks at the two resorts I'm dealing with them on and have the deeds on my computer. There is no independent closing company, it's all done by the same company like most high volume Ebay resellers. I prepared and emailed them a deed for the one I bought but don't know if they will use it. In talking to the sales person, I don't think they are dishonest but they've grown a lot and sounds like they've outgrown their ability to get the TS's transferred in a timely manner. I've gotten many TS's at the two resorts I'm dealing with them on closed and transferred within 3 weeks but they are saying it will take 3+ months due to the backlog they have. The second TS I'm talking to them about is a lot more money than the first one and although I'm willing to pay the credit card fee and pay with a credit card, I think you only have 60 days to dispute a charge so I'm leery of buying the second one. Many of the comments I've read on TUG regarding errors and delays give me a lot of concern about them.

I think you only have 60 days to dispute a charge so I'm leery of buying the second one.

The law is 60 days from the statement date that the charge is on. If you make the purchase right after your statement date then you would have about 90 days, which still isn't enough for a timeshare.

USE AMEX!

I am not sure if the law requires this but Amex has a much longer dispute period for these types of payments. Amex will go by the promised delivery day. If a purchase contract states expected delivery (closing) at 60 days, you would then have another 60 days to file the dispute if delivery has still not occurred. Other credit cards may do this as well but I am just not sure. What would be better is if the contract stated the expected resort transfer date rather than the closing date.

My Deed is Transferred

My Ebay auction ended on April 3 and I got notification from the resort that it got transferred on May 20. That said, as best I could tell, nothing happened until early May when I drafted the deed myself and emailed it to a nice and competent lady in their title area. They sent the deed to the owner, got it signed and took it from there. It seems to me they are overwhelmed with the volume of timeshares they are getting in and don't have adequate personnel to get the transfers done. FYI, Leisure Getaways (I think the corporate name is Legacy Adventures, Inc.) is the name of the company that takes in the timeshares. Apparently they are selling an RCI points program and they will take your timeshare(s) in trade for part of the cost of the new program. Apparently business is good as they are taking in a lot of timeshares.
