Wrong Coconut

I need some advice. I bought a 1 BR floating Red week through Ebay in August. The description and picture were for Coconut Palms Fishtail (CPF) where I already own 2 weeks.

I paid the closing costs and price to Resort Closings Inc. In late October, they sent me a deed for a unit at Coconut Plams II (CPB) down the street from CPF. It's a totally separate resort managed by different companies.

I contacted the closing company. They talked to the seller and apologized for presenting the wrong description. At first they said they'd find me a CPF week. When they didn't find one, they said the week would be relisted and my purchase refunded. They gave me contact information for the seller - Go Timeshares. However, they won't return my messages or emails.

Suggestions?

The real question as to whether you have a leg to stand on is not what the pictures and description were but what was on the contract! That being said, I would send them Certified Return Receipt USPS correspondence. I would contact the local BBB.
 
Sounds like the Frieds are at it again. If Uri Fried signed the transfer deed, you are basically out the money. You will never get the timeshare, and you will never get the refund.

Essentially the same thing happened to me years ago when I bought from the Frieds, and I never got my timeshare or my money back, though he did take back the original timeshare transferred to me.

The purchase contract says "Coconut Palms Beach Resort", but doesn't provide building name or address. The contract also references the Ebay #, which does include the address, but I'm not sure that reference means that what's in the Ebay listing is considered part of the contract.

That's not a fun situation. Share the details of the seller and the closing company, please.
 
If you paid the closing company, that money should be in escrow and not released to the seller until the deed is recorded. (At least that was the case whenI sold my TS). Since you did not go thru with the transaction and the agreed to a refund (if you have that in writing) then the closing company should issued a refund.

I had a similar situation when I sign a contract with an agent for an annual deeded week. The listing information was confirmed by the agent tru email. When a copy of the deed came, it was an every-other-year Right-to-Use.
I called the closing company that I had problems with the deed not agreeing with the contract. The closing company told me I can get a refund minus the document preparation cost of ~$250 because they already finished the documents.

The closing company also contacted the listing agent. The agent told me that I could not cancel the settlement and that the contract did not mean anything. I told her unless I get a full refund including the closing cost, I would file a complain with the real estate board in her state and the BBB. She backed off and agree to reimburse me for the full amount. The closing company sent back a check with full refund including the closing cost.

I would call the closing company again and asked them why they release the fund and insist on a refund or file a complain for fraud.
 
Me too.

I had a similar experience, but the company involved was GO Vacations, rather than GO timeshares. I think that it was simply sloppy research on the timeshare details, before posting on EBAY, rather than intentional fraud. I ended up going through with the transaction anyway, but probably would not have bid in the first place if it had been posted correctly.
 
You will find that GoVacations is now GoTimeshares - both located in Bozeman MT. There is an association with both Resort Closings Inc and Donate-For-A-Cause (also Bozeman) - and the eBay seller "sellingshares" amoung other eBay names.
 
Interesting.

The one I bought was a "trade-in" when the owners purchased at Lawrence Welk. This appears to be a channel for developers to dispose of units they have taken in exchange.
