Seller did not deliver the new unit by their deadline: 9-04-2007

here is the actual wording on the contract:

*Please see section 5 of the purchase agreement signed 9_04_2005:

5. Construction and occupancy. Purchaser may not occupy his unit until after all improvements to be constructed thereon have been completed. Purchaser fully understands that seller anticipates that the residence to be constructed on the lot will be completed prior to May 6, 2007, but cannot provide a fixed date for occupancy, by reason of factors influencing the rate of construction such as, but not limited to, acts of god, strikes, wars, availability of materials and the like. IN ALL EVENTS, THE SELLER WILL CAUSE SAID RESIDENCE TO BE COMPLETED NO LATER THAN TWO YEARS FROM THE DATE OF THIS AGREEMENT.

I am in contact with a lawyer near these timeshares.

He is claiming that he won judgements for 3 people with similar circumstances from the same company.

So, we are going to look into this further and possibly sue.

There may be hope for getting out of these contracts yet!
 
Good luck. I think that would be a nice resort but the maintenance fees are unrealistically low. I believe that's because they are still constructing. The fees will jump as soon as they are done.
