I just sold a timeshare in Kauai and I have heard it takes a LONG time for Hawaii to mail back recorded deeds. I have heard they record the deeds very quickly but it takes them forever to mail them back. Can anyone with experience with this tell me how long it will take to receive a recorded deed back in the mail form Hawaii? I know people use walk through recording for these but i am hoping just to do it via mail.

My experience as a closing company is upwards of 6 months to get the original back. If you use some closing companies, as part of the closing they get their attorney to have a runner take it and get a stamped conformed copy so that the resort can make the transfer.

There are other things to deal with in Hawaii, like there HARPTA tax. This is where a good closing agent will walk you through the process and handle all the paperwork for you.

Thanks for the info Dave H! Do you know if I can order a conformed copy and have it faxed or mailed to me? Also, does Hawaii mail a conformed copy automatically or does this have to picked up in person by a walk through in Hawaii?

I am not sure if they will mail it on recording, or if you go to the island time of getting the deed. I have an attorney in Honolulu that prepares all my deeds, as they are fairly long in Hawaii and then send a court runner down to the Bureau to record them when we send them to her. We send the day we fund the file, so the next day or 2 days later, I get an email with my documents in it.

So, in our case, they get it in person the day it records. There are other issues with the Bureau in that they tend to changes rules every few days and having someone on the island that can "go talk" to someone at the Bureau has been a help.

There are other issues like the new notary laws that it pays to have a good closing company help you in the transaction. Thats what the lawyer preparing the deed gets paid to make sure the deed is in full compliance with the law.

I spoke with the people that recorded my deed in Hawaii for our TS in Maui and they were extremely helpful in answering my questions about the time it takes to record a deed. It seems that the closing companies often do not send the correct forms or are lacking information. It usually takes several weeks to record the deed IF all the paperwork is correct.

I called the closing closing company directly and explained what forms were required to be sent and the correct information and within a week I received an email from Hawaii stating that my deed was recorded. I took the closing company an additional 2 weeks to send the same information.

Both of our TS closings took +7 months to record.

Both of our TS closings took +7 months to record.

My recent Hawaii closing took about a week from when the seller signed the deed to recordation to when Starwood recognized my ownership. I had a strong team in place: Syed Sarmad (Advantage Vacation) and Old Republic Title.

DaveH is correct in his comments above. The deed can be walked through and a conformed copy of the recorded deed can be faxed to the management company. It does require a local law firm or title company that knows what it is doing (and that does these transactions routinely) and that does cost a bit more. But if the result is getting your ownership recognized sooner, resulting in getting a superior use week the first year, it is money well spent.

Great Experience with Advantage Vacations

Over the last year we have bought two timeshares from Advantage Vacations and we can't say enough positive things about our experience. Syed Sarmad is very professional and it is a real pleasure doing business with him. He knows the business and walks you through the entire process. We have recommended him to several other timeshare owners and they also have had a very positive experience.

send a photocopy or 2 with your original for the BOC to record

You'll get recorded copies quickly. Recorded originals can take a very long time, they microfilm them before sending the originals out. Also, depending on the workload at the Bureau.

We recently purchased a resale Pahio EOY week. It took about 3 weeks for Kauai to get the deed recorded. About 3 months for Wyndham to complete the transfer........
