Has anyone dealt with Gallagher’s law firm to get out of a recent upgrade you purchased?

They called me and said if Wyndham had lied to me in the sales pitch they could have it canceled and my money refunded. The purchase was over a month ago.

Their caller ID was "Gallagher’S law firm Select SVCSVACATION"

one of the biggest red flags out there is someone cold calling you.

These operators have had multiple names. A few companies, and Charles Gallagher, an attorney in GA, have been sued by Wyndham. Probably as a result of the lawsuit, this new company was created. Timeshare.law was created only a couple months ago in August 2019. Interestingly, part of Wyndham’s lawsuit is that they were representing themselves as a real law firm. This new company clearly has “Gallagher Law Firm” listed on their website.

A prior business name is Timeshare Owners Relief, and has an F rating with the BBB.

That's always a very touchy, sketchy situation with these companies or law firms who say they can sue or cancel because you were lied to. While you may be able to sue or cancel because you were supposedly lied to, the onus is on you to prove that you were lied to. That's always the hardest part.

So in your case, how would you be able to prove that you were lied to? It would be your word against the salesperson's.

There is one simple rule to follow when it comes to Exit companies - do not ever do business with them. I was in the industry for years and I have yet to find one that didn’t exist primarily to defraud consumers who were often already vulnerable financially. Developers obviously have plenty of their own issues regarding promises and sales tactics, but at least you actually get something of value in return. In most cases exit companies will charge thousands of dollars and never deliver the cancellation as promised. At best, if you are able to get a cancellation, they will still charge you thousands of dollars.

If you feel you have a legitimate concern you would be better served by contacting a local attorney, paying them for an hour, perhaps two hours, of work, and have them contact the timeshare company.
