Attempting to Rescind HIVC

    On April 28th we signed the contract and returned home 2 days later with buyers remorse. I found a post from this forum with instructions on rescinding, found the info in the contract and sent the letter certified with all the marketing materials. I have gotten notification that the package was signed for, but the charge still sits on my CC. I know it has only been a week since they received request for rescission. How long before I should grow concerned? I am thinking of contacting my CC company and giving them a head's up about the charge. I asked for written verification from them, but after seeing multiple posts I guess I don't expect to get that? I feel uneasy about the whole thing, especially as our "salesperson" was basically bullying us towards the end of the transaction. Never again!

    Depending on when the refund hits your CC billing cycle, it can take up to 45 days to show up. Relax. HICV is honorable. They know they MUST process a timely rescission- it's the law and has stiff penalties. But they also know that there is no requirement that you be notified, or updated on the progress. Look at it from their point of view- they had you hooked and you got away. They don't love you or feel they owe you anything.

    Thank you. Still nothing. I am just worried that there is some small detail they will pick on...when we signed everything they were adamant about our signature and how they looked and how numbers in dates were formed. I may contact my CC company next week to see if they can see anything that is pending.

    We have now received documents from the closing/title company and still no refund. So i guess i have to attempt contacting them tomorrow.

    Ignore them. As long as you sent the rescission letter within the allowable time, they have NO CHOICE but to honor it. If you got =some correspondence from a closing company, they just haven't gotten the word that you are rescinding and to quit bothering you. These big corporations just get a ball rolling and it takes time for all the disparate arms to get in synch.

    That's the job of the "closer" in the TO (Take Over) sales system. They didn't take your car keys and throw the on the roof, you were free to leave at any time (and forfeit the shiny prize), or just keep saying "I will buy it resale on TUG"
