My wife and I have five timeshare deeds with Holiday Inn Club Resorts. On some of the deeds it appears that we own as tenants in common rather than joint tenants with rights of survivorship. Does anyone know how I can tell for sure on the deeds what the legal status of each deed is? How can I execute quit claim deeds in order to make sure that all the properties are JTWROS?

For what it's worth, when I was looking at some estate planning here in Tennessee, I read that they no longer allow "joint tenants with rights of survivorship". I haven't followed through to confirm that and it has nothing really to do with your situation, but it's possible that this sort of deed option is becoming obsolete. Just thought I'd mention it.

Depending on the state you may need tenants by the entirety, if a married couple.

Each State's laws are different. At 1 point Oregon did not allow Joint with Right of Survivorship. But the Courts wanted to carryout the intent of the Parties. So it was interpreted as each person having an undivided Life Estate with Cross Contingent Remainders.
