OP -- thanks for jumping in and clearing up a lot of the questions.

Under the circumstances, I doubt most of us would have done anything differently or better. You had your hands and head full.

I'm just guessing in your case, but in most cases if the mortgage is paid off and the developer is out of the picture, you are dealing with a resort Owner's Association. They do foreclose over delinquent maintenance fees. They can also collect default judgments and place liens on other real estate you own.

Whether that's what a particular association would do is up to them.

You should figure out who you are dealing with if you are planning on dealing with them.

This is a Vistana timeshare. The developer is not out of the picture. While the week is paid in full, Vistana is the management company and a full service one at that. They perform collection, lien filing and foreclosure on behalf of the HOA. So the OP needs to work through Vistana.

Thank you all so much. Truly. I know I still have a row to hoe with this thing, but all of your advice and insight has been invaluable. I have a least a general idea of what I need to do now, and that's a LOT better spot than I was in before I found this awesome forum. The world is truly full of wonderful people, and I'm grateful to have run across all of you! I'll keep you posted on what happens. Wish me luck!!!

“While Vistana continues to experience high loyalty and resort satisfaction rates, in the event an owner inquires about returning their vacation ownership interest, we work with them on a case-by-case basis,” he said.

I think the deed back offer is only for US timeshares. Mexico and the Bahamas are SOL. I still think deed back to the ex-husband is the best option. :D

Did you sign anything at the outset of all of this which could be considered a contract or did the timeshare sales just put your name on the deed at the request of your ex husband. If you strenuously objected at the time why would you agree to sign a purchase agreement? You might ask the resort management to provide you with a copy of the original agreement in which you and/or your ex agreed in writing to purchase. If you did not enter into any agreement in writing to purchase then it would appear that you are under no obligation and your name on the deed would not be an enforceable contract as there is no contract allowing the resort to put your name on the deed.

Then Get the paperwork completed
