What happen if I do not pay my maintenace fee?
I tried to buy me free from my contract last December. They requested over $ 2000 for that. When I would pay them, they wanted to have my credit card details including the CV code. I refused to hand it out.
Now it went out on time so I had to pay my maintenace fee, for 2017.
When I asked them in August this year about the same thing, I received a reply that they no longer had a surender program anymore.
Now I think I will not pay any more to this company, I am Swedish and live in Sweden.
What can they do ??

Frankly, they cannot do much of ANYTHING since you are located well outside of U.S. jurisdiction. Your timeshare has very little (if any) monetary value and it is simply not worth the effort or the expense for Summer Bay to pursue the matter once you stop paying fees. They will ultimately foreclose (at their own expense) and reclaim the ownership, although you will likely receive some meaningless, empty threat collections correspondence first.

You could consider a more "hard line" approach, clearly stating in writing that they can accept a "deedback" now, or initiate foreclosure later, but make it clear that you are not paying any more fees in either case. Make it very clear that they have only two choices and can "pick one". Just a suggestion.

It's what I would do under your circumstances. You might have to change credit card issuers, and they will write you all kinds of threatening letters, but I really doubt that there is anything they can do to put a black mark on your credit rating in Sweden. Eventually, they WILL foreclose, and there will be legal fees involved- that they will try to hold you responsible for, but frankly, if you can show that you made a good-faith effort to return the property to them, it was their choice to not accept the deed back. Whatever they do, it will have no effect on your ability to visit the United States. No one checks your credit rating when entering the country to see if you owe money.

Let us know how it works out. Best wishes for a successful outcome.

Jim
