Hello, I recently signed up for a HGVC definitely naive about this 9,000 studio, 2200 points. Is it too late because i’m seeing after the fact this cancellation notice that was never explained but tucked away in this big stack of papers. I live in MI and this point system I have sucks b/c nothing is available. I don’t know what options I have so I greatly appreciate any insight. Hindsight is definitely 20/20.

Welcome to TUG. Sorry to hear about your difficulties. It sounds like you are past the 5 day rescission period. If you are not, rescind immediately.

Otherwise, you have three options:

1) Sell or give it away. Depending on what you own 2,200 points may have to be given away. ($9,000 loss)

2) Figure out how to use and maximize it. You bought it for a reason. HGVC has great availability but you have to reserve 9 months in advance. You cannot reserve 2 - 3 months out because nothing will be available. Read the TUG stickies in the HGVC forum and the HGVC tutorials on the HGVC portal on how to reserve and maximize ownership. Many owners here purchased developer and figured out how to get the most out of their property.

3) Depending on where it's located, you could rent out your home week to cover Maint Fees or more. Again, you will need to learn about how to reserve. Note: You can only rent out what you are deeded in the season you purchased. If you can get a small profit the property may be worth keeping, otherwise you may want to give it away if you won't ever use the system ($9,000 lesson).

At this point, you have few choices. I take that you are beyond the allowable rescission period. AND if you owe money on the purchase, you can neither sell it (nobody will buy it) nor can you give it back.

If it makes the pain you feel a little better, about half of TUGgers bought their first TS from the developer and found out too late about rescission. So, what you need to do is hang around TUG and learn how to use what you bought. All those things the sales team told you, while there may have been some exaggerations and downright lies, have a kernel of truth. The reasons you found the caused you to buy are still valid. Now you need to find out how.

The first lesson- especially since you seem frustrated in not being able to find a vacancy you want to use is to book further out. Timeshares are not like hotel rooms. They are for the most part fully booked many months ahead. You just have to make your reservations as soon as you are eligible. Look at your contract, it will tell you how far in advance you need to be booking.

Those 'availabilities' that are in the online catalog are simply leftovers. It should come as no surprise that 'all the good ones are taken'.

being that close, we would suggest to try to rescind anyway.

If it turns out to be too late to rescind, it may help to know that you can borrow next year's points without penalty and combine with this year's. There may not be much appealing out there for 2000 points. You will have more booking options if you treat it as a 4000 point EOY vacation.
You could even combine 3 year's worth by saving this year's into next year and then borrowing for a total of 6000.

I thank you for the response. I LV Tower 52 vacation suites, club points 2200 given 8000 bonus points club points receive points in 2020 maintenance fees start in 2020. I haven’t started paying on the 9,000 as of yet. I’m gonna call to see about rescind or will see if my MI attorney general or Consumer Protection will help. I’m not paying to just stay in Vegas or Florida and I can’t plan 9 months in advance at this particular juncture of my life.

I gave Hilton who’s suppose to give me a call once email is received within a week. I called the State of Nevada Real Estate Division so I’m waiting on a compliance form. I wasn’t advised about rescinding this contract if I changed my mind. I thank God for this forum because I literally felt alone about this process and how to handle.

Jim I truly believe nothing beats a failure but a try. I wasn’t informed of my option to rescind. I take full blame for my impulse decision without doing my research. However, I did contact HGVC in which their going to email the sales Dept. I should have a response supposedly in a week. I contacted the Nevada Real Estate division in which they are going to send me a compliance form. I just want out not to pay and have to plan 9 months just to get availability that doesn’t work for me. Thanks a million!

yep, without actually sending the rescission letter all of your phone calls and emails are going to do you no good.

E-mails and phone calls and forms are not going to help!! You signed a LEGALLY BINDING contract. That contract did provide for a recession period. You don't have to be verbally told about the recession period, its in the contract that you signed. If you are only late by a couple of days they may honor your recession request. They also may not, as they are not legally required to, but you would only be out the cost of a certified letter to try. For any chance at saving 9K, i would send the recession letter ASAP!!

It can be just a very simple statement that you wish to rescind your purchase of (whatever you bought) on (whatever date you signed the contract). You could include a copy of the first page of your sales contract. If anyone else signed the contract with you, he/she should also sign the rescission letter.
