Another Recission Question

I'm very sorry to rehash things--I have read much about this in the forum and greatly appreciate all of the assistance and cumulative knowledge of the group.

We had signed a DRI on Thursday (3/21). After getting the particulars on USB form and reviewing this is not something we want to go forward with. There is the typical 5 day recission period after execution of the contract (3/26). The form in the paperwork given to us has the 10615 Park Run Drive Las Vegas address, place for signatures/address, contract number. I will be mailing the recission tomorrow (3/25) USPS registered mail.

Is there anything missing? Feel like an idiot for falling for this before getting/reviewing the particulars in the contract. I get why they give it to you on a USB now instead of hard-copy.

Thank you in advance! Now to DO MY HOMEWORK on the resale side.

@Rondaben there is no need to send it USPS Registered. Certified w/return Receipt will do fine and provide you with tracking and the name of the person that picks it up for less cost.

You aren't the first who has been taken in by the sales staff.

We've seen a couple reports of even Certified Mail failing to get delivered or it was severly delayed. Delayed is okay, but it is still stressful. I think more important than the the method of delivery you choose is to use two methods of delivery. This can be email or fax (if indicated in the contract) along with Certified Mail or First Class Mail (with Certificate of Mailing). Even if sending Registered or Certified, I would still suggest a second First Class Mail (stamp) with a Certificate of Mailing. The Certificate of Mailing is only an extra $1.95 on top of the price of the stamp, but the Certificate of Mailing provides postmarked proof that you keep to indicate the from, to and date it was mailed. They literally stamp the Certificate of Mailing with a second postmark in addition to the letter itself. These two methods of delivery should be nearly 100% foolproof.

@dioxide45 is correct about using Certificate of Mailing. Most folks have never heard of it and Lawyers use it all the time.

When you go to your local USPS Post Office ask to fill out PS Form 3800 (Certified Mail) as well as PS Form 3817 (Certificate of Mailing). Bring TWO envelopes with you that contain your rescission paperwork. Don't delay in getting both your USPS Forms Postmarked and be sure to retain them for your records.

Would anyone have a fax number to the vegas office?
If it is an option you can use to rescind, it would be in your contract. If it isn't in the contract then don't fax. Follow the instructions in the contract.
