And the issue in front of the court is law, not science.

This type of scenario was considered by Congress when it enacted the Clean Water Act, and the Congress elected to separate groundwater from surface water, even though it is scientifically clear that the two are interrelated. Over the years, judicial decisions have chipped away at the distinction that Congress clearly made.

So the issue in front of the court is going to turn on whether this is a matter that belongs in the Courts or in Congress. What the science is in this case is really irrelevant. Of course, the partisans on either side will frame it differently, as to whether the court is going to allow or prohibit pollution. But the issue really involves separation of powers and judicial deference to Congressional intent.

The current makeup is known to rule in favor of corporations over environmental concerns. This is of more concern (to me) than who appointed them. Only forward is where action plays, past is for learning.

Now that everyone understands the issue here, I'm going to delete the posts that are no longer pertinent, and clean up the thread, so that it stays open for the waste water discussion. Thank you to everyone who posted.
